Statute of Limitations for Medical Malpractice Claims in Nevada
In Las Vegas, Nevada, the Statute of Limitations for filing a medical malpractice claim is generally set at two years from the date the injury occurs as per Nevada Revised Statutes.
However, for cases where the injury is not immediately discovered, the clock starts ticking when the patient discovers it, but this must occur within four years of the alleged malpractice. (NRS) 41A.097.
The “one year” time limits remain for cases before October 1, 2023. For injuries or wrongful deaths from between October 1, 2002, and September 20, 2023, patients must file within three years of the injury or one year after discovering it, whichever is earlier. NRS 41A.097(2).
