Workers' compensation is a grand bargain: in exchange for guaranteed medical care and wage benefits without having to prove fault, injured workers give up the right to sue their employer in civil court. That trade sounds fair in the abstract. In practice, the system is run by insurance carriers who are measured on how little they pay out, and the rules governing reporting, medical care, independent medical exams, and impairment ratings are dense enough that most workers cannot fight a denial without help.
Every state runs its own workers' compensation system with its own deadlines, its own list of approved doctors or provider networks, and its own formula for calculating temporary disability, permanent partial disability, and permanent total disability. Some states let you choose your own doctor; others let the employer pick. Reporting windows are brutally short. Miss the notice deadline and you can lose the claim entirely, even for an injury that is obviously work-related.
George Goldberg and our attorneys have helped injured workers navigate denied claims, delayed treatment, surveillance disputes, settlement negotiations, and, when the facts allow, third-party lawsuits against a negligent subcontractor, equipment manufacturer, or property owner separate from the workers' comp claim. That third-party avenue is often where the real recovery is, and it is commonly missed by workers handling claims on their own.
The articles below explain how workers' comp works, how to protect your claim from the first day, what to do when treatment is denied, and how to tell when a third-party case may exist alongside your comp file. The FAQ addresses the most common early questions we hear.
