Legislative changes have broadened the time during which survivors of childhood sexual abuse can bring civil claims, and in some circumstances the law recognizes that the trauma itself delays the ability to come forward. Beyond the individual perpetrator, civil claims often reach the institutions that enabled or ignored abuse (schools, churches, youth programs, medical providers, employers, residential facilities, and foster care systems) when they failed to protect the people in their care. These institutional claims are often where meaningful accountability and compensation come from.

Frequently Asked Questions

Is it too late to bring a civil claim for sexual abuse that happened years ago?
Possibly not. Oregon has expanded the civil statutes of limitations for sexual abuse claims, particularly those arising from childhood abuse, and there are rules that account for delayed discovery and trauma-related delay in reporting. The exact deadline depends on when the abuse occurred, when you became aware of the connection between the abuse and your injuries, and who the defendants would be. Will my case become public if I file a civil lawsuit?
Not automatically. Many survivor cases are handled under confidential settlement agreements, and courts in Oregon have mechanisms for protecting the privacy of survivors, including the use of initials or "Jane Doe" captions in some circumstances. We discuss privacy options in detail at the outset, and we never move on a filing without your informed consent.
Can I sue an institution, like a school or church, not just the individual abuser?
Often yes, and those institutional claims are frequently the most important part of a survivor case. If an organization knew or should have known about abuse, failed to supervise or investigate, moved a perpetrator between positions, or ignored complaints, it may be legally responsible for the harm it enabled. Institutional defendants also typically have resources that individual perpetrators do not.
Do I have to go to the police to have a civil case?
No. A civil lawsuit for damages is separate from the criminal justice system, and you do not need a criminal charge, conviction, or police report to bring one. Many survivors choose not to involve law enforcement for their own reasons, and a civil case can proceed without that step. We can walk you through the options and pros and cons of each.
