How long do I have to file a personal injury lawsuit in Oregon?
Oregon generally gives you two years from the date of the injury to file most personal injury lawsuits. However, claims against a public body (like TriMet or the City of Portland) require a tort claim notice within a much shorter window, and medical negligence and wrongful death cases can follow different rules. Oregon uses comparative fault. What does that mean for my Portland injury case?
Oregon follows modified comparative fault with a 51 percent bar. That means if a jury finds you 50 percent or less at fault, your recovery is reduced by your percentage of fault; if they find you 51 percent or more at fault, you recover nothing. Do I have to use my own PIP before the other driver's insurance pays?

Your PIP carrier then typically has a right to be reimbursed out of any settlement with the at-fault driver. Using PIP does not raise your rates when you were not at fault, and it should never be skipped.
What if the driver who hit me was uninsured or underinsured?
Oregon requires UM/UIM coverage on every auto policy for exactly this situation. If the at-fault driver has no insurance or not enough insurance to cover your injuries, we file the claim against your own UM/UIM carrier. That is what you pay them for. These claims still require proof of fault and damages, and insurers fight them harder than most people expect, which is why having an experienced lawyer matters.
