Oregon law is actually quite protective of pedestrians, but knowing the law and enforcing it against an insurance company trying to blame the person on foot are two very different things.

Under Oregon law, every intersection is a legal crosswalk, whether it is marked or not, unless pedestrian crossing is specifically prohibited. Drivers are required to stop and remain stopped for pedestrians in the crosswalk, and failure to do so is both a traffic violation and strong evidence of negligence in a civil case. Oregon's modified comparative fault rule still applies (if a jury finds the pedestrian more than 50% at fault, recovery is barred), which is why insurers so often push the narrative that the pedestrian was "darting out," distracted, or crossing outside a marked crosswalk. A careful investigation usually shows a very different picture.
