Motorcycle cases in Portland are defined by two things: physics and prejudice. The physics are obvious: a rider in a crash absorbs forces no passenger car driver ever feels, which is why motorcycle injuries are disproportionately catastrophic even in low-speed collisions. The prejudice is less obvious but just as real: insurance adjusters, jurors, and even investigating officers often arrive with the unspoken assumption that the rider was speeding, lane-splitting, or taking risks, even when the evidence says otherwise. A good motorcycle accident case starts by dismantling those assumptions.

Oregon is a modified comparative fault state with a 51% bar, meaning a rider found more than half at fault cannot recover at all. That single rule is why insurers work so hard to attribute blame to the motorcyclist, and why our firm invests heavily in accident reconstruction, witness interviews, and preservation of vehicle and scene evidence in every serious motorcycle case. Oregon does not recognize lane splitting as lawful, which the defense will try to weaponize, but the legality of the rider's conduct at a specific point in time is a fact question that a careful reconstruction can often answer in the rider's favor.

I am George Goldberg, founding partner of Goldberg & Loren. In more than 32 years and over 20,000 injury cases, my firm has handled motorcycle crashes ranging from urban intersection collisions to catastrophic highway wrecks. Helmet use, gear, riding history: we know how the defense will try to use each of these, and we know how to neutralize them with evidence and testimony. Our Portland office is at 6500 S Macadam Ave Ste 380, Portland, OR 97239.

Below you will find our Portland motorcycle resources and answers to the questions riders and their families ask us most often after a crash. Frequently Asked Questions

Can I still recover if I was not wearing a helmet in an Oregon motorcycle crash?
Oregon law requires motorcycle riders and passengers to wear helmets, and non-use can potentially affect certain categories of damages, particularly those tied to head injuries the helmet might have prevented. It does not, however, bar a claim outright. The defense will absolutely raise helmet use, and we know how to limit how much weight that argument gets.
How do insurers try to blame the motorcyclist?
Common tactics include claiming the rider was speeding, weaving, lane-splitting, not visible, or failing to wear proper gear. Many of these claims collapse under proper reconstruction: skid patterns, debris fields, vehicle damage angles, and witness statements often tell a very different story from the one the first responding officer wrote down in the crash report.
What coverage applies if the driver who hit me had no insurance?
Your own uninsured and underinsured motorist coverage is the primary asset. Oregon requires insurers to offer UM/UIM on every auto policy, and most motorcycle policies either include it or offer it as a stand-alone add-on. If you are not sure what coverage you had, bring the declarations page to the first meeting and we will read it with you.
How long do I have to file a Portland motorcycle accident claim?
Oregon generally imposes a two-year statute of limitations on personal injury claims arising from a motorcycle crash, measured from the date of the collision. Claims against public bodies require a much earlier tort claim notice. Contact us promptly. Serious motorcycle cases benefit from early investigation before evidence disappears.
