Is California an at-will employment state, and does that mean I can be fired for any reason?
California is an at-will state, which means your employer can generally terminate you without cause and you can quit without notice. But at-will does not mean no rules. It is illegal to fire someone because of a protected characteristic, in retaliation for protected activity such as reporting wage theft or harassment, or in violation of public policy. Those exceptions are where most wrongful termination cases live.
How long do I have to file a wrongful termination or harassment claim in California?
For FEHA claims, meaning discrimination, harassment, retaliation, California gives you three years to file a complaint with the Civil Rights Department, followed by a right-to-sue letter that unlocks a one-year window to file suit. Wage-and-hour claims can run one, three, or four years depending on the theory. Deadlines vary by claim type, so do not assume. Call us to confirm the specific window that applies.
What is PAGA and how can it help a Bakersfield worker?
The Private Attorneys General Act lets an aggrieved employee sue an employer on behalf of the State of California for civil penalties owed for Labor Code violations, including unpaid wages, missed breaks, and inaccurate wage statements. Recent amendments to PAGA have changed some procedures, but it remains a powerful tool for workers whose individual damages might be too small to justify a traditional lawsuit.
My employer paid me a flat day rate in the oilfields. Am I owed overtime?
Possibly yes. California overtime law generally requires time-and-a-half after 8 hours in a day and 40 hours in a week, and double time after 12 hours in a day, and a flat day rate does not automatically satisfy that requirement. Whether you were properly classified and properly paid is a fact-intensive question we look at in every oilfield and ag case we take.
Can I be retaliated against for reporting harassment or a safety issue?
No. California law broadly prohibits retaliation against employees who report harassment, discrimination, unpaid wages, Cal/OSHA safety violations, and other protected activity. Retaliation itself is a separate claim, and in practice, retaliation claims are often easier to prove to a jury than the underlying violation that triggered them.
